Mississippi Courts Are Available to Protect Rights, Including Federal Anti-Discrimination Laws

Mississippi courts can protect you against discrimination in the workplace. The federal Civil Rights Act of 1964 must be respected by employers, including Title VII which protects against race discrimination, sex discrimination, sex harassments, retaliation, the Age Discrimination in Employment Act (ADEA), the Americans with Disability Act (ADA), the Fair Labor Standards Act (FLSA), the Family Medical Leave Act (FMLA) and Title IX. According to these statutes, employers cannot discriminate against employees including based on the following characteristics:

  • Age
  • Race
  • Color
  • Religion
  • Sex
  • Disability
  • Gender

Additionally, Mississippi workers may not be discriminated against for retaliatory actions, such as opposing a discriminatory practice by their employer or participating as a witness in an investigation by the EEOC.

Have you been discriminated against or retaliated against for protecting your rights or the rights of others?  We can help you. Have you been wrongfully terminated?  There are Mississippi and federal laws that protect you and we will be glad to assist. Do you own a business wrongly accused of illegal employment practices?  We represent small businesses too. Have you been fired for reporting or refusing to engage in illegal activity?

Filing a Discrimination Claim

Employees who feel they have been discriminated against in the workplace have the right to file a claim. Note that Mississippi does not have a state administrative agency that handles these claims, so employees should file their discrimination claims with their local Equal Employment Opportunity Commission (EEOC) agency. The office located in Jackson, MS, is at:

Dr. A. H. McCoy Federal Building. 100 West Capitol Street, Suite 207, Jackson, MS 39269

The Federal Law sets a strict deadline for employment discrimination claims in certain matters. Many claims require workers to file their charge against their employer with the EEOC within 180 days of the date they last experienced the workplace discrimination.

Individuals can either file their complaints in person through an appointment or online. It is best to work with a lawyer on your claim, as an attorney can more efficiently gather and organize the relevant evidence and collect any witness statements about the workplace discrimination that occurred to help strengthen the employee’s case. An attorney can also help evaluate whether the employee should proceed with just a claim or also a civil lawsuit for more serious cases, such as a demotion, failure to hire, retaliation or loss of your job (wrongful termination).

You have rights that deserve to be protected. No one should experience any form of discrimination, especially when it affects their status as an employee or applicant for a job. If you believe you have been harassed, retaliated against or discriminated against, whether for your age, race, sex, disability or gender, reach out to Hawkins Law, P.C. for legal assistance on your next steps to file a discrimination claim or even sue your employer.
